CODETERMINATION REQUIRES A CLEAR POSITION.

Your Lawyer for Staff Representation Law

The authority acts even though documents are missing? New software, amended duty rosters or a dismissal raise questions: what rights exist, which deadlines are running, what needs to be done now? As specialist employment lawyers we help you enforce participation rights and negotiate durable solutions. What matters is recognising the legal options early – before facts are created.

BPersVG or state law: the applicable law is determined by the federal or state authority
No standard deadline: the deadline for submitting comments depends on the relevant legislation and the form of participation
3-week time limit for employees to bring a claim under Section < 2 >4< 3 > of the Employment Protection Act (KSchG) – separate from the time limits applicable to committees
Which law applies? As a general rule, the BPersVG applies to federal government departments, whilst the relevant regional legislation applies to regional and local government departments. Participation rights, time limits and procedures may vary.
01Co-determination & Conflict Resolution

Enforcing participation rights
vis-à-vis the department

If the department provides information too late or incompletely, this makes it more difficult for your body to carry out its statutory duties. We will check what information and documents you are entitled to receive and whether there are provisions for co-determination, participation or consultation. This will enable you to request timely and complete information and to assert your rights of participation vis-à-vis the department’s management on a sound legal basis.

If a consent period is already underway, a blanket rejection or a delayed decision may weaken your position. Depending on the procedure, silence may be interpreted as approval. We check the start date of the period, the completeness of the information provided and the requirements regarding the grounds for the decision. We provide support in ensuring that the committee reaches a valid decision and that it is submitted on time – as the basis for further steps.

In the event of disputes, depending on the law and the subject matter of the dispute, negotiation, a multi-stage procedure, a conciliation board or the courts may be considered. Not every conciliation board issues a final decision; interim relief is subject to specific conditions. We will work with you to assess the prospects, risks and costs. Before you instruct us, we will clarify the necessary board resolution and the conditions regarding who will bear the costs.

Keep a record of receipt, missing documents, enquiries, meetings and the communication of decisions. Subsequent requests do not automatically suspend time limits. Have the time limit checked at an early stage.

Frequently asked questions about your shareholder rights

When is it advisable to seek legal advice?

In cases where documents are missing, there is a dispute over involvement, urgent measures are required, or a refusal to grant consent is imminent, it is advisable to carry out an early review. When making contact, please quote the case reference number and the specified deadline.

What can we do if the documents are incomplete?

Request any missing information relevant to the task in a specific and verifiable manner. Record receipt of the information. The start and duration of the time limit depend on the necessary notifications and procedures.

What deadline applies to our statement?

There is no uniform deadline; the governing factors are the applicable law, the form of participation, urgent cases, and permissible agreements regarding deadlines. For each procedure, verify receipt, the completeness of the information provided, and the deadline.

Does the conciliation board always make binding decisions?

No. Statute and subject matter determine jurisdiction and the binding nature of decisions. Under federal law, only recommendations are provided for in some cases; the highest competent authority retains the right of final decision. Judicial clarification may be necessary..

Who bears the costs of legal advice?

The responsible public entity bears necessary costs in accordance with applicable law, rather than covering every mandate on a flat-rate basis. The following must be verified in advance: the task, necessity, proper authorization (resolution), scope of the mandate, and required coordination.

Which court protects our participation rights?

In principle, administrative courts make the decisions; the availability of urgent legal protection must be assessed separately. Labor courts may have jurisdiction over individual employment law claims and specific statutory cases.

02 Shaping working conditions

Regulate working hours and digitalization
in a binding manner

Duty rosters, short-notice overtime, and mobile work require rules that take into account both employee interests and operational workflows. We examine the scope for action under employee representation law, alongside statutory regulations and collective agreements. Based on this, we work with you to develop positions on working-time accounts, availability, and schedulable assignments—clearly distinguishing between minimum requirements and negotiable elements.

Time tracking, digital HR management, and AI can make it possible to analyze employee data as well as performance or behavior. What matters are functions, data flows, and actual usage—not the product description. We review participation rights and develop rules regarding purpose limitation, access, data deletion, and analysis. We also factor in updates and new features to ensure that technical changes do not undermine protections.

A service agreement must be tailored to the specific agency and remain within legal boundaries. We assist you with drafting, reviewing, and negotiating agreements, as well as establishing rules regarding duration, monitoring, and conflict resolution. While templates offer useful guidance, they do not replace a formal review: the decisive factors remain applicable federal or state law, the precedence of collective agreements, and the specific circumstances of your agency.

Tip:

A presentation is not enough: before deploying the software, review roles, permissions, stored data, reports, and data retention periods. Document outstanding issues and clarify who needs to be involved.

Frequently Asked Questions about Service Agreements

On what aspects of working hours does the staff council have a right of co-determination?

Depending on the applicable legislation, this covers aspects such as start and end times, breaks, working time models, and distribution across the days of the week. Statutory regulations and collective agreements limit the scope for flexibility; special rules apply to shift schedules and short-notice assignments.

Is every new piece of software subject to co-determination?

It is not the job title that matters, but rather the actual deployment and the criteria triggering involvement—such as monitoring or new work methods. Have your existing functions, access rights, and data analysis capabilities reviewed.

What should be included in a service agreement on mobile work?

Access, time recording, availability, equipment, data protection and occupational safety, as well as physical presence, changes, and disputes. Permissible content is governed by law, collective bargaining agreements, and overarching agreements.

Are we permitted to alter collective bargaining law via a service agreement?

Not arbitrary: Statutory restrictions on regulation and the primacy of collective agreements apply. An express opening clause in a collective agreement may permit additions. Examine the specific subject matter of the regulation before concluding the agreement.

How do we ensure participation regarding updates and AI features?

Agree on permissible information and review processes regarding new data uses, interfaces, and analyses. Whether renewed involvement is required depends on the nature of the change and applicable law.

What should be done if the agency fails to honor agreements?

Document violations, demand remedial action in accordance with the applicable regulations, and utilize agreed-upon monitoring or conflict resolution procedures. If no action is taken, we will consider further legal steps and court applications.

03 Representing employee interests

Supporting personnel measures and restructuring

Controversial appointments, incorrect job classifications, or unwanted transfers require careful scrutiny. We clarify the applicable form of participation, the necessary documentation, and the permissible grounds for objection. Regarding collective bargaining issues, we take the relevant job criteria into account. This enables you to base your position on verifiable facts and distinguish between the rights of the representative body and the claims of individual employees.

Participation does not amount to a general veto: under federal law, the requirement is "co-determination" for ordinary terminations and, in principle, a "hearing" for extraordinary terminations; state laws and special cases may differ. We review the information provided, any objections raised, and the tight deadlines. Important: A statement issued by the representative body does not replace an unfair dismissal claim filed by the affected individual, nor does it preserve the deadline for filing such a claim.

Mergers, outsourcing, and staff reductions link organizational and personnel issues. Request information early regarding planning, responsibilities, and the impact on employees. We review every measure and develop negotiation objectives concerning skills training and compensation for disadvantages. Social plans are governed by the specific legislation on employee representation; rules applicable to works councils cannot simply be transferred.

Tip:

Track deadlines for committees and individuals separately. As a general rule, a lawsuit challenging a dismissal must be filed within three weeks of receipt of the written notice of termination. Immediately refer affected individuals to legal counsel.

Securing committee rights and individual claims separately: A statement issued by the staff council does not preserve the deadline for filing a personal lawsuit. Click the graphic to enlarge it.

Frequently Asked Questions About Personnel Measures

Can we reject a hiring or a transfer?

Where co-determination rights exist, consent may be refused on statutory grounds—provided the refusal complies with the requisite deadlines and formal requirements. General dissatisfaction with personnel policy is not sufficient for this purpose.

What role does the staff council play in classification?

Where participation rights apply, the committee reviews the remuneration schedule based on the assigned duties and their classification. The individual concerned must, if necessary, personally pursue any claims for higher remuneration.

Can we prevent termination by lodging an objection?

It is not automatic: the law, the type of termination, and special protection against dismissal are what count. Raising objections is no substitute for filing a lawsuit challenging the dismissal. However, the termination may be invalid if required consultation procedures were not followed.

What deadline must terminated employees observe?

In principle, there is a three-week deadline—starting from receipt of the written notice of termination—for filing a lawsuit with the labor court (Section 4 of the Protection Against Dismissal Act/KSchG); special cases must be assessed individually. Discussions or statements from representative bodies do not extend or suspend this deadline.

Is there always a social plan in the event of a restructuring?

No. Whether and to what extent this applies depends on staff representation law and specific disadvantages. The rules regarding the reconciliation of interests and social plans under the Works Constitution Act (BetrVG) do not automatically apply to staff councils.

Can the staff council's lawyer also represent employees?

Not automatically covered by the committee mandate: A separate mandate, costs, and potential conflicts of interest must be assessed. A clear separation is required when making selection decisions and dealing with conflicting employee interests.
